Modifications
Though child support and custody were settled in your final divorce decree and alimony was finalized, circumstances and lives inevitably change. As such changes occur, they impact the agreements previously settled at the time of divorce.
Under Florida law, custody and support order modifications may be justified due to a substantial and material change in circumstance of either party. Such change in circumstances may include:
- The loss of a job or change in employment
- An increase in income
- Visitation problems
- Erratic behavior and its impact on the child-parent relationship
- Change of residence
- Change in marital status
When a modification is clearly necessary and is in the best interest of the child, courts can modify a custody or support order.
